AUSTRIA – Regulated Gambling
Regulated gambling products: Sports betting, horse race betting, poker, casino, bingo and lottery.
Operator type: Austrian Lottery Corporation has exclusive rights to online poker, casino, bingo, and lottery until 2027, but private operators can get sports betting and horse race betting licences. Casinos Austria owns Austria’s 12 land-based casino licences.
Status: The CJEU has ruled that the Austrian casino monopoly is incompatible with EU law in several cases, but national courts continue to reach conflicting decisions on Austria’s gambling legislative framework’s compatibility with EU law, leaving the position unclear. The Austrian Supreme Court sided with a player who sued an EU-licensed operator for losses in June 2021, ruling that their contract was invalid. February 2021 saw the Austrian Finance Minister propose major gambling reforms. Website blocking, independent regulation, and player protection are proposed. In December 2021, the Austrian Finance Minister stated that preparatory work was ongoing, but a draught law outlining the proposed reforms was not published.

BELGIUM – Regulated Gambling
Lotteries are only available from the monopoly supplier. Online businesses must partner with a land-based licensee or apply for a retail licence that can be expanded to include online operations to meet the local establishment requirement.
Status: There is still evidence that the current system violates Belgium’s EU Treaty obligations. Operators and players are enforced. All licenced operators must cap weekly deposits at €200. Belgium submitted a draught Royal Decree to the European Commission in May 2022 to restrict gambling sponsorship and advertising.

Status: The Ministry’s gambling legislation updates have been criticised for EU incompatibility (including the requirement that only land-based licensees can offer online gambling). Countrywide regulatory reforms appear to have stalled.

Operator type: OPAP has a monopoly over lottery operations; betting licences are available to private operators.
Status: Cyprus licenced online betting in 2016. Cypriot ISPs must block unlicensed gambling websites. In March 2019, a new betting law replaced the 2012 Betting Law. The new law is mostly the same, with minor changes to address EU incompatibility issues (like the need for a local branch to get a betting licence). The local regulator tightened gambling advertising regulations in July 2021.

DENMARK – Regulated Gambling

Operator type: Licences for all gambling products are available to private operators save for lotteries, which are controlled by the state monopoly.
Status: Danish online gambling began on January 1, 2012. The Danish Gaming Authority (DGA) has an injunction to block operators and suppliers targeting Danish customers without a licence, and the jurisdiction blocks ISPs. Since January 1, 2020, licenced operators must require customers to set deposit limits before gambling, but only in online casinos. From April 2020, the DGA implemented new marketing regulations. Self-regulatory “Gambling Advertising Board” was founded in August 2021.

ESTONIA – Regulated Gambling

Operator type: Licences for all gambling products are available to private operators save for lotteries, which are reserved exclusively for the monopoly operator.
Status: Estonian operators must obtain an activity licence for the type of gambling they offer and an operating permit to provide services online. Local authorities and ISPs update a blacklist of operators and block payments. Since the requirement for licensees to main servers in Estonia was removed, the EC has not issued a notification of incompatibility, though some operators claim it is.

Status: After Finnish law changes, EC enforcement action was dropped despite a national monopoly. Enforcement includes offshore operator marketing restrictions. In January 2022, Finland’s gambling law was amended to allow the Police Board to take administrative action against private operators targeting the Finnish market. Payment blocking provisions take effect on January 1, 2023.

Status: A regulated market since the introduction of a licensing regime in 2010, following which the EC withdrew its infringement proceedings. In March 2022, ANJ, the French gambling regulator, was granted administrative powers to block illegal gambling websites.

GERMANY – Regulated Gambling
Regulated gambling products: Sports betting, horse race betting, virtual slots, online poker and table games
Operator type: Horse race betting licenses are regional. Private operators can apply for sports betting licenses starting January 2020. Private operators can apply for virtual slots and online poker licenses since July 2021. Online table games like roulette, blackjack, and live dealer casino are only available at land-based casinos, most of which are state-run (although Schleswig-Holstein and North Rhine-Westphalia have passed laws to allow private operators to offer them).
Status: The EC and interested parties/states in Germany have long criticized Germany’s main gambling regulation framework. The 3rd Amendment Treaty was approved on January 1, 2020, after legislative reform discussions. The 3rd Amendment Treaty reinstated sports betting licensing and removed the license cap. The 4th Interstate Treaty on Gambling took effect in July 2021, allowing private operators to license online poker and virtual slots (with stake limits).In October 2020, a transitional toleration regime allowed operators to offer online poker and slots if they met certain requirements and stake limits. On December 31, 2022, toleration will end. The November 2022 Saxony-Anhalt “White List” lists 35 sports betting and 14 slots licenses. The Joint Gambling Authority of the States, a pan-German gambling regulator, will begin operations on January 1, 2023.

GREAT BRITAIN – Regulated Gambling

Operator type: All licences are available to private operators save for lottery, which is reserved exclusively for the monopoly provider, Camelot.
Status: Any operator that transacts with, or advertises to, British residents requires a licence from the Gambling Commission (GC). Licensed operators are required to source gambling software from GC-licensed businesses. Last December, the government launched a “wide-ranging” review into the current gambling legislation in Great Britain. It is anticipated that any proposals for reform will be published in a white paper that is expected in the short term.

GREECE – Regulated Gambling

Private operators can obtain two “Types” of licences under the permanent licencing regime: Type 1 for online betting and Type 2 for other online games like poker and casinos. However, former state-owned entities have exclusive rights to bingo, lottery, pari-mutual betting, and fixed-odds horse racing betting.
Status: In 2012, the Greek government granted 24 operators transitional licences to serve Greek residents. In 2019, legislation mandated open licencing for online betting and “other online games,” including casino and poker. The permanent licenced market launched in July 2021 after the regulations implementing the new legal regime were published in August 2020.

HUNGARY – Regulated Gambling

Operator type: Only the state monopolies (Szerencsejáték Zrt. and Magyar Lóversenyfogadást-Szervezo Kft) and local concession companies can apply for a licence.
Status: Hungarian gambling law was amended on October 1, 2015, to allow only two land-based casinos remote casino concessions. The regulator has fined unlicensed market operators, some of whom have appealed. In June 2017, the ECJ found Hungary’s gambling regime violated Article 56 TFEU. The current regime violates EU law after the ECJ overturned the Hungarian requirement that online gambling operators have a land-based licence to serve Hungarians in February 2018. Sports betting will be legalised in Hungary on January 1, 2023, under new gambling laws.

IRELAND – Regulated Gambling
Regulated gambling products: Online betting regulated since August 2015. Online gaming is not specifically accounted for in Ireland’s outdated legislation and as such is currently unregulated.
Operator type: Private operators can apply for a betting licence.
Status: Ireland has contemplated updating its legislation, which will create a comprehensive igaming regime, for some time. Interim reform measures intended to modernise the regulation of gambling in Ireland entered into effect on 1 December 2020. Draft legislation published in April 2021 (by an opposition party) which, if passed, would restrict most forms of gambling advertising, progressed to committee stage in March 2022. In October 2021, the General Scheme of the Gambling Regulation Bill was published which covers, among other things, the planned introduction of a B2C and B2B licensing regime and the establishment of the Gambling Authority of Ireland. The ‘Gambling Regulation Bill’ was published on 2 December 2022.

ITALY – Regulated Gambling

Operator type: Fully regulated market, although lotteries are the subject of a state monopoly.
Status: Remote gambling licences are granted within specific application windows. The last tender process for applications closed on 19 March 2018. AGCOM, the Italian communications regulator, has issued sanctions against operators and media companies for violation of the gambling advertising ban (introduced in 2018). Measures to combat unlicensed gambling, including payment blocking measures, entered into effect in October 2019. It is understood that Italian authorities are currently preparing a draft law on a 2023 licensing tender process that will reduce the number of available online licences to 40.

NETHERLANDS – Regulated Gambling

Status: On 1 April 2021, the Remote Gambling Act established the Dutch licencing regime and market, which opened on 1 October 2021 with 10 licences. The new regime allows operators to apply for licences. However, operators that have directly “targeted” the Dutch market will face a 33-month cooling-off period before being eligible for a licence and may be penalised for providing their services to Dutch players (even passively) until they are licenced.

NORWAY – Regulated Gambling

Operator type: Online gambling is reserved for the two monopoly providers, Norsk Tipping and Norsk Rikstoto.
Status: The monopoly has added live betting, online bingo, and casino games to attract traffic from unlicensed sites. Norwegian regulators are cracking down on unregulated operators, local banks, and payment service providers. The government has strengthened enforcement powers to stop offshore gambling advertising and supply. On January 1, 2020, payment blocking expanded. On January 1, 2023, legislation consolidating Norway’s gambling laws and strengthening the regulator’s powers to block websites advertising unlicensed gambling will take effect.

Operator type: Betting licences are available for companies with a representative in Poland. Casino and poker are reserved for a state monopoly.
Status: Betting was legalised on January 1, 2012. Since April 2017, online gaming, including poker, is legal, but a state monopoly has exclusive rights to sell it. On July 1, 2017, unlicensed operators were blacklisted and ISP and payment blocking went into effect.Over 1,000 domains are blacklisted.

On February 26, 2016, secondary legislation fully implemented the licencing regime. Gambling regulators notify ISPs to block blacklisted websites.

SLOVAKIA – Regulated Gambling

Operator type: Private operators can apply for licences for online casino as of 1 March 2019 and for sports betting licences from 1 July 2019. Lottery and bingo remain reserved for the monopoly provider.
Status: The Gambling Law took effect March 1, 2019. The Gambling Law allows private operators outside Slovakia to apply for sports betting and casino licences. The Slovakian gambling regulator created a whitelist of licenced operator websites in July 2022.

SLOVENIA – Regulated Gambling
Regulated gambling products: Sports betting, horse race betting, poker, casino, bingo and lottery.
Operator type: Online gambling must be operated by land-based casinos or lotteries and, as a result, only the monopoly holds online licences in Slovenia.
Status: Certain industry stakeholders believe it violates EU law to limit licences to land-based Slovenian operators. 2015 Gaming Act draughts sought to eliminate the local establishment requirement. However, the proposal has not yet been submitted to parliament. Any proposed amendments may not lead to an open licencing system.

SPAIN – Regulated Gambling
Regulated gambling products: Sports betting, horse race betting, poker, casino, bingo and lottery.
Operator type: Private operators can apply for licences for all gambling products save for lottery.
Status: Operators must hold a general licence and a specific licence, both issued by the National Gambling Commission, for each activity. Remote gambling licences are granted within specific application windows. The last tender process for applications closed on 18 December 2018. In November 2020, Spain introduced significant restrictions on gambling advertising, sports sponsorship and welcome bonuses.

SWEDEN – Regulated Gambling
Regulated gambling products: Betting (including sports, horse race, pool, exchanges), casino, poker, bingo and lottery.
Operator type: Licences are available for private operators.
Status: Sweden is fully regulated since January 2019. Depending on the product(s) offered, gambling operators must obtain a “betting” or “commercial online games” licence to legally serve Swedish residents. Enforcement occurs. Swedish parliament approved B2B licencing and restrictions on illegal gambling promotion and advertising in November 2022.
